Terms & Conditions

  • If Newman Cams agree to any change/variation in the work to be completed or products to be supplied this shall be deemed to be an amendment to this agreement rather than a new agreement.
  • Products supplied will be following our specifications unless a written variation is agreed upon. Minor variations which do not adversely affect the products may be made.
  • No liability is accepted for products that after delivery suffer loss or damage.
  • Products are warranted free from defects in normal use for six months after delivery unless otherwise stated.
  • No third party is intended to benefit from any express or implied warranty given in respect of products supplied by Newman Cams.
  • This agreement is made in England, shall be subject to the exclusive jurisdiction of the English courts and shall be governed and construed following English law.
  • An estimate/pro forma is considered an approximation of the likely cost of the work and or products and is valid for fourteen days from when we present it to you.
  • Any estimate/pro forma is based on the published price for the products involved at the time of the estimate/ proforma, if a consequent increase in the products occurs we will notify you of any such increase and an amended estimate/pro forma will be produced.
  • Newman Cams will use our best efforts to do work and or supply products within any time estimate we have provided you, but we will not be held liable for delays due to any cause outside our control, we will not accept cancellation of orders due to delays met during the manufacture of products.
  • Should we require a partner to work in conjunction with Newman Cams in the manufacture of a product and or products Newman Cams is not responsible for the output of this partner and therefore does not guarantee any workmanship or manufacture.
  • Unless credit terms are agreed, all payments must be made in cash or by credit/debit card, BACs transfer, PayPal unless Newman Cams have expressly given the right to pay via cheque, in which case the cheque must be drawn on a UK clearing bank and not received less than five banking days before you wish to receive the products.
  • Newman Cams are entitled to retain any products until payment has been received in full.
  • Newman Cams will accept the return of items that you did not specifically order within five working days of delivery, you must produce our original invoice and method of payment, and we may invoke a handling charge should the returned item not fall into our return criteria.
  • We reserve the right to change these terms and conditions and should any amendments be made Newman Cams will serve notice of this to you in writing Any tooling, fixtures, documentation and any intellectual property rights therein vest solely in and belong to Newman Cams.
  • Any exclusive product line agreement we hold with you will be reviewed yearly and it is at our discretion if Newman Cams decide to terminate any agreement; notice of termination of this agreement will be served, this notice period is three months, during this period new terms and conditions will be issued and should you decide to continue with your exclusive range, acceptance of the new terms and conditions is required in writing. During the notice period, your trading terms will continue until the expiration of the notice or unless otherwise stated in writing.
  • If the terms and conditions of the exclusive product range are not met in writing within the notice period Newman Cam's reserves the right to reproduce this product and market and sell these product(s).
